Terms and Conditions
1. Scope of Application
These General Terms and Conditions (GTC) apply to all orders placed through the Blütezeit Wien online shop (Owner: Dieter Altenburger, VAT ID: ATU63441289, hereinafter referred to as the “Provider”). The version of the GTC valid at the time of the order shall be applicable. Deviating terms and conditions of the buyer will not be accepted.
The full contact details and personal information of the provider can be found in the website’s Legal Notice.
2. Conclusion of Contract
The presentation of products in the online shop does not constitute a legally binding offer, but rather an invitation to place an order. By clicking the “Buy” or “Place Order” button, the buyer submits a binding offer to purchase the goods contained in the shopping cart.
The order confirmation sent via email constitutes acceptance of the offer and thus the conclusion of the contract. The provider reserves the right to refuse orders without stating reasons.
3. Prices and VAT
All prices quoted include the statutory Austrian value-added tax (20% on all goods offered), unless otherwise stated.
For deliveries within the European Union, VAT will be shown according to the regulations of the respective destination country in accordance with applicable EU rules.
For deliveries outside the European Union, prices are net. Import duties, taxes, and import VAT are the sole responsibility of the buyer (see point 7). The same applies to the formalities of import processing into the buyer’s country of destination.
4. Payment Terms
The provider offers the following payment methods:
- Credit Card / Debit Card (via Stripe): The charge is made immediately after completion of the order.
- PayPal: Payment is made via the buyer’s PayPal account.
- Bank Transfer (Prepayment): The order will be processed after receipt of full payment. Bank details will be provided in the order confirmation. Payment must be made within 7 business days.
The purchase price is due upon conclusion of the contract. In the event of late payment, the provider reserves the right to charge statutory default interest.
5. Delivery and Shipping
The provider generally delivers worldwide. Shipping costs are displayed during the ordering process before the binding order is submitted. For all countries where no shipping costs are specified, please send us an email and we will endeavor to find a solution. However, we reserve the right not to ship to countries for which shipping costs are specified by default if a crisis, import restrictions, or restrictions by the transport company, etc., occur at short notice.
The delivery time for deliveries within Austria is 2–4 business days, within the EU 3–7 business days, and international 7–21 business days, unless a different delivery time is specified for the respective product.
The risk of accidental loss and accidental deterioration of the goods passes to the buyer upon handover to the buyer or the commissioned carrier.
6. Retention of Title
The delivered goods remain the property of the provider until full payment of the purchase price.
7. Import VAT and Customs Duties for International Deliveries
For deliveries to countries outside the European Union, additional costs in the form of import duties, taxes, and import VAT may apply. These costs are not included in the purchase price and are not borne by the provider.
The recipient is solely responsible for the payment of all applicable import duties and taxes. It is recommended to check with the relevant customs authority of the destination country regarding the applicable regulations and costs before ordering. Blütezeit Wien assumes no liability for delays or additional costs resulting from customs clearance.
8. Right of Withdrawal
8.1 Cancellation Policy
Consumers are entitled to a right of withdrawal in accordance with the Austrian Distance and Off-Premises Transactions Act (FAGG):
You have the right to withdraw from this contract within fourteen days without giving any reason.
The withdrawal period is fourteen days from the day on which you or a third party named by you, who is not the carrier, took possession of the goods.
To exercise your right of withdrawal, you must inform us (Blütezeit Wien, Owner Dieter Altenburger – full address in the Legal Notice) of your decision to withdraw from this contract by means of a clear statement (e.g., a letter sent by post or an email). You may use the attached model withdrawal form for this purpose.
To meet the withdrawal deadline, it is sufficient for you to send the communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.
8.2 Consequences of Withdrawal
If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than fourteen days from the day on which we are informed about your decision to withdraw from this contract.
For this reimbursement, we will use the same means of payment that you used for the initial transaction. We may withhold reimbursement until we have received the goods back. You must return the goods to us immediately and in any event no later than fourteen days. You shall bear the direct costs of returning the goods.
8.3 Model Withdrawal Form
(If you want to withdraw from the contract, please fill out this form and send it back.)

I/we hereby withdraw from the contract concluded by me/us for the purchase of the following goods:
Ordered on: ___________________________
Received on: ___________________________
Name: ___________________________
Address: ___________________________

9. Warranty
The statutory warranty provisions of Austrian law apply. The warranty period is two years from the handover of the goods. In the event of a justified warranty claim, the buyer is initially entitled to repair or replacement.
10. Limitation of Liability
The provider is liable without limitation for damages resulting from injury to life, body, or health, as well as for intent and gross negligence. In the case of slight negligence, liability is limited to foreseeable, typical damages.
11. Data Protection
The collection and processing of personal data takes place exclusively for the purpose of contract execution and in accordance with the GDPR and the Austrian Data Protection Act. Further information can be found in our Privacy Policy.
12. Online Dispute Resolution
The EU Commission provides a platform for online dispute resolution: https://ec.europa.eu/consumers/odr/. Participation in a dispute resolution procedure before a consumer arbitration board is not mandatory and is not intended.
13. Applicable Law and Jurisdiction
Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). For consumers residing in the EU, this law applies only to the extent that it does not restrict mandatory consumer protection provisions of the state of residence. The place of jurisdiction for disputes with entrepreneurs is Vienna.
14. Severability Clause
Should individual provisions of these GTC be or become invalid, the validity of the remaining provisions shall remain unaffected.
